Infringement Notice Requirements

  • A physical or electronic signature of the copyright owner (or a person authorized to act on their behalf);
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the infringing material to be removed and information reasonably sufficient to allow us to locate it (please provide the exact URL to help us identify the allegedly infringing content);
  • Information reasonably sufficient to allow us to contact the complainant, including name, physical address, email address, and telephone number;
  • A statement that the complainant has a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notice is accurate, and under penalty of perjury, that the complainant is authorized to act on behalf of the copyright owner.

Note: Title 17 USC §512(f) provides for civil damages, including costs and attorney’s fees, against any person who knowingly and materially misrepresents information in a DMCA notification.

Counter Notification – Restoring Content

If you have received a DMCA notice stating that content you provided was removed due to copyright infringement, you may submit a counter-notification requesting that the material be restored. This notice must be in writing and contain the following, in accordance with 17 USC §512(g)(3):

  • Your physical or electronic signature;
  • Identification of the material that was removed and its location prior to removal;
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • Your name, address, and phone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., that you consent to jurisdiction in any district where the service provider may be found), and that you will accept service of process from the party who submitted the original DMCA notice.

Repeat Infringer Policy
